Proposed Regulation Amendments for Registrants' and Stakeholders' Review

As a result of changes to the Regulated Health Professions Act (RHPA) and improvements recommended by the Council, the College is currently circulating proposed amendments for the Quality Assurance Regulation and Registration Regulation to registrants and stakeholders for review and comment.  All responses should be sent via mail to the Registrar by April 9, 2010.

Meetings are posted in newspapers and are normally held in the College Board Room at 2100 Ellesmere Road, Suite 300, Scarborough, Ontario from 10:00 a.m. to 5:00 p.m. They are open to the public and to members of the College. If you are interested in attending, please contact the College at (416) 438-5003 to reserve a seat.

To make presentations to Council, please notify the Registrar in writing 30 days prior to the scheduled meeting date.

Advertising Advisory

IMPORTANT ADVISORY TO ALL MEMBERS
Professional Advertising - What is Not Acceptable
Recently the College received leaflets, advertorials, letters and copies of advertisements and web-pages used by some members to promote their laboratory services. Review of these promotional materials showed that testimonials of dentists and/or patients are included. This is in breach of the Advertising Regulation and Professional Misconduct Regulation. As a result, the Executive Committee had to take actions requiring the concerned members to take corrective actions.

To help members, we remind you that advertising of a member's practice is governed by Ontario Regulation 604/98 made under the Dental Technology Act, 1991, Part II, Advertising. Use of dentists' and patients' testimonial is not allowed as Section 11. (1) (d) states:

"11. (1) An advertisement with respect to a member's practice must not contain,

(d) a testimonial by a client, patient or former client or patient or by a friend or relative of a client, patient or former client or patient."

Further, Ontario Regulation 798/93 made under the Dental Technology Act, 1991, Professional Misconduct, states:

"1. The following are acts of professional misconduct for the purposes of clause 5(1) ( c) of the Health Professions Procedural Code:

16. Advertising or permitting advertising with respect to the member's practice in contravention of the regulations."

The College interprets "client" to be dentist(s) or other health care practitioner(s) who supplies prescriptions and any other records, models, diagrams, written and verbal instructions for the design, fabrication, repair or alteration of dental prosthetic, restorative or orthodontic devices needed by patients. Here, the College considers "patient" to be a patient of a dentist, health care practitioner and/or an RDT.

It is important that before you promote your services, review the Advertising Regulation to ensure that your advertisement meets the parameters set out in the Regulation, regardless of the style, format, mode of dissemination and media you decide to use. Laboratory Supervision


THE STAMP CANNOT BE ALTERED
OR SKEWED
2010 RDT Stamp
Registered Dental Technologists who are authorized to supervise dental laboratories or who are authorized to operate his/her own practices should have received their 2009-10 stamp to carry out their responsibilities. The new stamp will expire on December 1, 2010.

The College will only approve laboratory supervision status and issue a new 2009 stamp to qualified dental technologists who continually meet the Laboratory Supervision Standards and comply with legislative requirements.

Advice to the Public and Dentists:

If you do not see a Registered Dental Technologist's stamp on an invoice, a case release document, design consultation, etc., please call the College immediately at 416-438-5003 to ascertain whether or not:
  • A qualified dental technologist is authorized to supervise on-site the design and/or fabrication of the dental appliance; and
  • A qualified dental technologist is taking full responsibility of the case.

Medical Devices

Purchase of Licensed Medical Devices for Use in Dental Health Care
In February 2006, Health Canada reminded dental health practitioners, including dentists, dental technologists and denturists to comply with Canadian Medical Devices Regulations when using medical devices to provide services to patients.

"Medical Devices" in dental technology practice refers to "materials and components" used to build and fabricate dental devices. They are normally classified, according to the level of risks, as Class II or Class III devices. Because of the high risk level, the Medical Devices Regulations prohibit dental laboratories or dental health care practitioners from importing, selling and advertising the sale of Class II and Class III devices, unless the manufacturer of the device is licensed by Health Canada. Health Canada further advises that dental health care practitioners NOT to purchase unlicensed devices. This is consistent with the College's published Practice Standards that RDTs use Health Canada licensed materials and components.
